This Candidate Privacy Notice (“Candidate Notice”) describes how Baker Hughes Company and its subsidiaries and related companies (collectively, “we,” “our,” or “Baker Hughes”) process the personal information of individuals who apply to work for a Baker Hughes company, attend our recruiting events, or otherwise provide information for an assessment to work for Baker Hughes (collectively, “Candidates”). This includes job applicants/prospective employees, interns, and contractors. This Candidate Notice applies to our careers website, available at careers.bakerhughes.com (“Careers Website”) and not to any of our other websites. If you visit or otherwise access any of our other websites, including bakerhughes.com, other privacy notices may apply to you.
 
At Baker Hughes we value your privacy and are committed to protecting and processing your personal information responsibly and in compliance with applicable law.
 
This Candidate Notice explains:

Who is responsible for your personal information?  
·      If you are applying for employment or internship at Baker Hughes: The Baker Hughes company identified as the recruiting Baker Hughes Company is responsible for processing your personal information, either solely or jointly with its affiliates within the Baker Hughes family of companies.  
·      If you are being engaged as Baker Hughes temporary or leased worker (“Contingent Workers” or “Contractors”): The Baker Hughes Company that has contracted for the services, either solely or jointly with its affiliates within the Baker Hughes family of companies, and your employing company or agency is responsible for your personal information. Certain sections of this privacy notice related to employment-related information are applicable to Baker Hughes prospective employees only. If you are being considered for an assigned as a Contractor to work at Baker Hughes, Baker Hughes does not collect or receive your employment related information controlled by your employing company or agency.

Our processing of sensitive personal information is subject to additional safeguards as required by applicable law.

We or our vendors may use cookies and similar tracking technologies that collect certain information about you when you access or use the Careers Website, such as Internet Protocol address, device identifier, browser type, operating system, browsing information such as pages viewed, data regarding network connected hardware (e.g., computers or mobile devices), the domain name of the website that allowed you to navigate to the Careers Website, search engines used, the length of time spent on the Careers Website, and the frequency of your visits to the Careers Website.
 
We may combine tracking technology information with other personal Information about you. We or external parties may collect personal information about your online activities over time and across different online services when you use the Careers Website.

Your personal information, including sensitive personal information, is processed for the purposes specified above and will only be shared – in this context, “share” means provided to or allowed access to or use of – on a strict need-to-know basis with:
 
·         Other companies within Baker Hughes group of companies. We share Candidate personal information among our various businesses and affiliated companies, and internally within Baker Hughes in order to assess your application to work for Baker Hughes and to provide and improve our services. We may transfer and share personal information outside Baker Hughes as reasonably necessary to meet our business needs as long as such transfer and sharing is not prohibited by applicable law.
·         Authorized third parties, agents, service providers, external auditors, and sub-contractors. Baker Hughes engages vendors and other business partners to provide services for us. We may share your personal information to our vendors or business partners – for example, to assist with our recruitment and hiring, immigration services, to provide IT services and support, and other activities. We require our vendors and business partners who have access to personal information to comply with contractual obligations to adopt and maintain safeguards similar to those we use to protect personal information with respect to any data processed on our behalf and in compliance with applicable law and to maintain the confidentiality and security of personal information.
  • Social Network Providers. We may share personal information with social network providers depending on your interactions with social network widgets, buttons, or plug-ins in our Careers Website.
·         Any party to whom Baker Hughes proposes to transfer any of its assets, rights, or duties. We may share your personal information with a third party if we sell or transfer all or a portion of our business or our assets to a third party, including during the negotiations of such sell or transfer.

Baker Hughes, as a company operating worldwide, may transfer, disclose, and store the personal information of Candidates in the United States, where we are headquartered, or in any other country where we or our business partners and third-party vendors, who process data on our behalf, operate, including in Malaysia. The information protection and privacy laws in these countries may offer a lower level of protection than the applicable laws in your jurisdiction. We take appropriate measures in compliance with applicable law to protect any personal information that we transfer to another location, including safeguards legally required to protect personal information during transfer and other processing outside the country where it was collected. When required by applicable law, we will obtain your consent to the transfer and processing of your personal information outside of your country of residence.
 
By using our Careers Website and submitting your personal information, you agree to the transfer, storage, and/or processing of your personal information in the jurisdictions in which we operate.

To the extent that one of these third parties is a vendor that helps Baker Hughes perform certain business functions, or performs certain business functions on behalf of Baker Hughes, we have entered into agreements with these vendors to ensure that they process personal information in accordance with applicable privacy laws and ensure the protection of your rights.

Baker Hughes retains Candidate personal information for as long as necessary for the purposes described in this Candidate Notice or to achieve the purposes for which the information was collected, or as may be permitted under applicable law. In determining retention periods, we consider factors such as our legal and contractual obligations, as well as the amount, nature, and sensitivity of personal information, the purposes for which we process the personal information, and the potential risk of harm that may result from unauthorized access to the personal information.

Baker Hughes has adopted and maintains administrative, technical, physical, and organizational safeguards consistent with relevant legal requirements and commercial standards to protect your personal information from loss, theft, misuse, inadvertent destruction, or other unauthorized processing. As part of these safeguards, we restrict and monitor access to your personal information, so that only those who need to know the information, and have proper authorization, can access, or otherwise process it.
 
We also require our vendors and business partners who have access to personal information to comply with contractual obligations to adopt and maintain safeguards similar to those we use to protect personal information with respect to any Candidate data processed on our behalf.
 
Every individual within Baker Hughes is responsible for protecting personal information about Candidates. Baker Hughes personnel must follow and comply with applicable law and the Baker Hughes polices, including Baker Hughes’ Enterprise Privacy Policy and other relevant policies and procedures related to the protection of personal information.

We rely on the accuracy, integrity, and reliability of your personal information to be able to comply with our business obligations. To help us with this, we expect you to report any changes to your personal information, such as changes to your contact information.
 
In accordance with applicable law and subject to certain restrictions, you may have the right to know what personal information we process about you and to review, access, correct, delete, port, and/or restrict or object to our processing of such personal information. If we collected your information based on your consent, you can withdraw your consent for processing your personal information. Baker Hughes will honor any rights in your personal information provided to you by applicable law, unless an exception or restriction prevents us from fully honoring your request, in which case we will explain such exception or restriction in our response to you.
 
It is the policy of Baker Hughes not to disclose any information in response to a privacy rights request that may adversely affect the privacy of other persons unless legally required to do so.
 
We do not subject Candidates to automated decision-making with respect to decisions that have a significant impact on them, unless we have a valid legal basis for doing so and have provided any required notice in advance.

Your CCPA Rights in Your Personal Information
 
Subject to appropriate verification of your identity, you may ask us for your personal information in our possession, or information about such personal information, and you may ask us to delete your personal information, correct inaccuracies in your personal information, and/or restrict or object to our processing of such personal information. You may also designate an authorized agent to submit a request on your behalf. To do so, you: (1) must provide that authorized agent written and signed permission to submit such request; and (2) may be asked to verify your own identity or confirm the request directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf. You can expect that we will respond to your privacy rights request within 45 days, unless we reach out to explain that it will take us longer. If we cannot fulfill your privacy rights request, we will explain why.

This section provides additional information on our processing of personal information related to individuals located in the European Economic Area and the United Kingdom.
 
EEA/UK Privacy Rights. If you are located in the EEA/UK, you have certain rights to the personal information that we have collected about you, and you may exercise those rights independently or through an authorized agent. We will comply with your request within one month, unless we reach out to explain it will take longer. Requests to exercise your rights may be granted in whole, in part, or not at all, depending on the scope and nature of the request and applicable law. To prevent unauthorized requests related to your personal information, we take steps to verify that you are the person that is the subject of the request. Following verification of your identity, we will notify you if we are able to fulfill your request and if we are unable to fulfill your request, we will outline the reasons we are unable to honor your request at this time.

Subject to applicable law, you may have the right to access, port, de-index, re-index, cease dissemination of, update and correct inaccuracies in your personal information in our custody or control. When requesting access to your personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the personal information that we hold about you. Your right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In the event that we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.
